Furthermore, such services may not be advertised via deceptivemarketing policies, as defined by the FederalTrade Commission Deception Policy Statement.  | General Conduct - Members/Clients are prohibited from transmitting on or through any of JAWA's services, any material that is, in JAWA's sole discretion, unlawful, obscene, threatening, abusive, libelous, or hateful, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law.
- JAWA services may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of United States or state regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or any other statute. JAWA reserves the right to remove such illegal material from its servers.
- The customer is responsible for keeping his personal data with JAWA up-to-date and accurate. Furnishing false data on the signup form, contract, or online application, is grounds for immediate termination, and may subject the offender to civil or criminal liability.
- The resale of JAWA products and services is not permitted, unless specifically permitted and documented in a written agreement.
|  | System and Network Security - Customers may not attempt to circumvent user authentication or security of any host, network, or account ("cracking"). This includes, but is not limited to, accessing data not intended for the Customer, logging into a server or account the Customer is not expressly authorized to access, or probing the security of other networks (such as running a SATAN scan or similar tool).
- Customers may not attempt to interfere with service to any user, host, or network ("denial of service attacks"). This includes, but is not limited to, "flooding" of networks, deliberate attempts to overload a service, and attempts to "crash" a host.
- Customers may not use any kind of program/script/command, or send messages of any kind, designed to interfere with a user's terminal session, via any means, locally or by the Internet.
- Users who violate systems or network security may incur criminal or civil liability. JAWA will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.
|  | Email - Harassment, whether through language, frequency, or size of messages, is prohibited.
- Customers may not send email to any person who does not wish to receive it. If a recipient asks to stop receiving email, the customer must not send that person any further email. If you are having difficulty with a JAWA.ORG address, please contact the Abuse Reporting & Response Services at abuse@jawa.org.
- discount hotels in PerissaCustomers are explicitly prohibited from sending unsolicited bulk mail messages ("junk mail" or "spam"). This includes, but is not limited to, bulk-mailing of commercial advertising, informational announcements, and political tracts. Such material may only be sent to those who have explicitly requested it.
- Customers may not forward or otherwise propagate chain letters, whether or not the recipient wishes to receive such mailings.
- Malicious email, including but not limited to "mailbombing" (flooding a user or site with very large or numerous pieces of email), is prohibited.
- Forging of header information is not permitted.
- JAWA accounts or services may not be used to collect replies to messages sent from another Internet Service Provider, where those messages violate this Acceptable Use Policy or the Acceptable Use Policy of that other provider.
- These rules apply to other types of Internet-based distribution mediums as well, such as RLG's Ariel system (a system for sending FAX-like documents over the Internet). USENET postings have their own regulations; see below.
- You can not use the JAWA hosting services to post offensive, pornographic, hate, or illegal materials.
|  | USENET - JAWA does not maintain USENET services. However, our members may post to USENET via their own personal ISP accounts. As a result, we have established USENET rules.
- Postings to USENET newsgroups must comply with the written charters or FAQs for those newsgroups. Advertisements should only be posted in those newsgroups whose charters/FAQs explicitly permit them. The poster is responsible for determining the etiquette of a given newsgroup, prior to posting to it.
- Customers are prohibited from posting the same or similar message to large numbers of newsgroups (excessive cross-posting or multiple-posting, also known as "USENET spam or Velveeta").
- Customers are prohibited from posting chain letters of any type.
- Customers are prohibited from posting binary files to newsgroups not specifically named for that purpose.
- Customers are prohibited from canceling or superseding posts other than their own, with the exception of official newsgroup moderators performing their duties.
- Customers are prohibited from forging header information. This includes attempting to circumvent the approval process for posting to a moderated newsgroup.
- A customer may not solicit mail for any other address other than that of the customer's JAWA account or service, with the intent to harass or collect replies after JAWA service has been terminated.
|  | IRC (Internet Relay Chat) JAWA does not offer IRC services. |  | Individual Accounts (POP Email/Hosting Users Only) - JAWA telnet accounts are intended for use by an individual. Multiple logins are prohibited. Shell account users may not run programs which provide network services from their accounts, such as IRC or MUD servers.
- JAWA shell accounts are intended for interactive use. Attempts to circumvent the 'idle daemon' or time charges accounting, or attempts to run programs while not logged in by any method, are prohibited.
- JAWA shell accounts operate on shared resources. Customers are prohibited from excessive consumption of resources, including CPU time, memory, disk space, and session time. The use of resource-intensive programs which negatively impact other system users or the performance of JAWA systems or networks is prohibited, and JAWA or authorized network staff may take action to limit or terminate such programs.
- Password security is the responsibility of the individual user. Good passwords should be a minimum of six characters long, contain at least one number or symbol, and are not based on any dictionary word or common name. Customers may not share passwords or accounts with others.
|  | Hosting You can not use the JAWA hosting services to post offensive, pornographic, hate, or illegal materials. Violations If you violate the Acceptable Usage Pollicies, your account will be terminated without refund or question as in our Zero Tolerance Policy. Also, we reserve the right to charge $150.00 per offense. If you interfere with our investigation, the charge is $500.00. |

JAWA does not trade, sell, or release lists of the members of JAWA.All members agree to utilize this directory for personal contact in a non offensivemanner. Our usage rules also restrict users from any "systematic, substantial and/orregular replication of materials supplied to the system for redistribution for commercialpurposes and/or financial gain". We record your address and phone number in order to contactyou if your email address becomes invalid. The information may be released to other listedmembers only with your express authorization. Exceptions are court orders or legal order. Content Of Personal Information: You warrantthat the personal information that you have provided to JAWA is accurate to the best ofyour knowledge. The information you provide to JAWA is your own name and personalinformation and not that of another person. With respect to free form text, you agree notto use profanities or to use the system for any purpose that is illegal. Joliet Alumni Web Right To Delete Or RefuseInformation: JAWA reserves the right to delete (or refuse to post) any materialsit deems detrimental to the system. A User's Right To Have Information Deleted:JAWA will delete any material or information submitted by you or regarding your name ore-mail address at your request. Using The Directory To Contact Other Persons:You agree to not use the information obtained from this directory to contact persons in away that they find objectionable. If you violate the Acceptable Use Policy or any otherapplicable rules, JAWA will take appropriate action, which may include terminating youraccess to the system. Copyrights: While you may preserve yourcopyright interest in submitted material, if any, all materials and information submittedby you for display on the system will become part of a database, the compilation copyrightfor which is owned exclusively by Joliet Alumni Web Incorporated. Moreover, by submittingsuch materials and information, you agree to (i) grant JAWA and subscribers to the systema paid up, perpetual, world-wide irrevocable license to use, copy, and redistribute suchmaterials and information and any portions thereof and any derivative works therefrom and(ii) warrant that you have all the rights necessary to submit such material or informationand that the use of same by JAWA and subscribers to the system will not infringe any otherparty's rights. Copying Of Information From The Directory: Asa member, you agree that you will not engage in systematic, substantial and/or regularreplication of materials supplied to the system for redistribution for commercial purposesand/or financial gain. Warranties: As a subscriber, you shouldunderstand that neither JAWA nor any of the parties that provide material or informationfor the listings or services make any warranty concerning the accuracy of any materials orinformation, or the continuing availability of such materials or information found on orexchanged through the system. In addition, JAWA and such parties hereby disclaims any andall warranties, express or implied, including without limitation any implied warranty ofmerchantability or fitness for a particular purpose. Liability: In no case shall JAWA's liabilityto you exceed the amounts paid to JAWA during the year prior to your claim. JAWA's soleobligation and your sole and exclusive remedy in the case of any liability will consistsof a duty by JAWA to refund the previously mentioned amount. Spam Investigation & Reporting (Revised 1-11-98):JAWA reserves the right to release RFC 822 headers to any ISP who provides a writtenrequest to our offices. JAWA will not release any further information without priorconsent. JAWA will make every attempt to contact you if your message has been released toparties outside of JAWA. We reserve the right to release the entire message or portionsthereof if the message does not relate to the operation of the JAWA (i.e. advertisements,spam, etc.) Report abuse to abuse@jawa.org or tojawa.org@abuse.net. Changes To Rules: JAWA reserves the right tochange the Acceptable Use Policy and applicable rules. Obviously, if the rules change insome way that you find unacceptable, you are free to have your name or information removedfrom the database.
